If you own the Fallout francise and sell it, you already ARE at the bottom. Heck, if even a J.Anderson (from the original Fallout team) jumpes ship before this whole court craze started, it's clear to see how it would come out.
The Fallout MMO being developed by Interplay sounded like second-most-likely vaporware (right after Duke Nukem Forever) from the very first announcement.
Interplay today has nothing to do with what it once was. It's just some unknown guys trying to profit from past glory, who thought "Fallout + MMO = $$$".
If these guys actually used their brains to a certain extend, they would have secured the rights to continue the "van Buren"-path. Seeing how many Fallout fans (not just NMA) gotten vocal about Fallout 3 being just Oblivion with different style, this should have given them something to put their feets on solid ground. Instead they tried to make leaps with nothing in their pocket.
The good part is, that J.Anderson headed to InXile where he joins Brain Fargo again. And that InXile purchased the rights on Wasteland from EA back in 2003 - a much safer investment if you have to put your money down on one those two companys.
