Well, I wrote asking if the game was going to use any form of DRM and if so which type. Here is the response I received regarding Darkstar.

We're not even sure what platforms we will offer DS on, so Digital Rights Management is still down the road as well. Of course we don't want pirates to rule our ship, but we'll make sure that viable players enjoy the experience to the level they deserve.

I appreciate them writing back some companies would not even show this level of respect.
For me though, it clearly will include DRM and unless it is a simple disk check I will take a pass on it. Too bad really; I would have dearly liked to play this one.
