Linko64: You can't expect people to follow a CoC if those enforcing it don't even know the CoC.
With such a vaguely worded (in some places) COC, is that any wonder in some cases?
(aside: I think most of the forum's mods likely know the COC well enough to be able to mod appropriately if they choose to do so)

Come with me on a murky journey through 3 lawsuits about a man's reputation.

3 years ago, back before masks suddenly became hip and cool, Chris Avellone got cancelled. Specifically, he was accused of using his "star power" (lol the man writes RPGs) at conventions to make passes at women (there are women at these things?). 3 years later we don't even know what a woman is. How time flies. But according to Business Insider at the time, "Karissa, told Business Insider that Avellone forcibly kissed her and then tried to put his hand down her pants while she was "blackout drunk" at a 2012 convention. She says he stopped when she told him 'this isn't a good idea.'" For his part at the time, Chris Avellone made the mistake everyone was making, and apologised on Twitter... for breaking up with her friend:

Karissa does hate me, it is true. Very much, and I do not know how to fix it, but recognized when you hurt someone's friend, there may be no fix at all, except between the two people involved. And there's never any need to "support" me, I do not wish this.​

He doubled down for good measure, once again apologising for how his relationship had ended with her friend:

He had no idea what was coming. It became a pile-on as more allegations involving Avellone surfaced, with Kelly AKA GlitterBroker (a close friend of Karissa) claiming she was also groped by him at a convention during which she had said she was fat and kryptonite to the "frat boy element there", as well as a porn star taking offense that he had misread the text she sent him at 3 AM. Game journos took the women at their word - even though Karissa and Kelly had publicly declared they suffer from bipolar disorder, a condition often linked to issues with the truth - reporting that Chris was roaming around conventions drugging and assaulting everyone he could find. The gaming industry dumped him like a hot potato, with Techland, Paradox Interactive, and Gato Studio dumping him from Dying Light 2, Vampire: The Masquerade - Bloodlines 2, and The Waylanders respectively. All distancing themselves from Chris like he was infected with some kind of deadly virus that would spread around the globe if anyone got too close to him - and wearing masks wasn't enough. Chris Avellone was no longer a name people could add to their RPG KickStarter as a way of attracting donors. He had become a pariah.

Time went by and the world moved on, with Chris' reputation in tatters. But Chris eventually did what any good American does: He sued. On the 16th June 2021, in Stanley Mosk Courthouse, CHRISTOPHER AVELLONE, AN INDIVIDUAL VS KARISSA BARROWS, AN INDIVIDUAL, ET AL. (search for case number: 21STCV22573) was filed. The defence of Chris Avellone had begun.

Without getting too legal, Chris had sued Karissa Barrows and Kelly Bristol in California. Initially, the case went well. The trial judge rejected the anti-SLAPP motion from Karissa and Kelly (which is to say, the judge felt the case wasn't a frivolous waste of time and was worth proceeding with). However, the judge did agree that California did not have jurisdiction over Kelly, so she was removed as a defendant. The judge ruled that the lawsuit against Karissa could go forward. Karissa filed an appeal against that.

Almost a year later, the Appellate Court ruled that California did not have jurisdiction over Karissa either and asked Chris to pay her attorney fees. Her attorney was working pro bono for her, so she did not have any fees per se... But the U.S. legal system allows pro bono lawyers to get paid as if they weren't pro bono in situations like this. Chris, we thought, had lost.

However, since the case was dismissed for jurisdictional reasons, not for merits, Chris was able to start a new case in Oklahoma against Kelly (the link only works if you're in the USA) and a new case against Karissa in Illinois (their respective home states).

Kelly attempted to have the Oklahoma case dismissed but it was allowed to continue. There was some attempted counter-suing from Kelly. The Illinois lawsuit was also allowed to go forward. Eventually though, there were trial dates and everything. And discovery was supposed to begin... but not before court mandated mediation.

... and the parties settled, issuing a joint statement. Chris Avellone posted the (above quoted) joint statement on his Medium account.

It's a little vague but we've been able to confirm that the settlement is in Chris Avellone's favour. And both the Oklahoma and Illinois cases are now settled.

Whether this sees the return of Chris as a writer on game projects, especially as we see attempts at cancelling now failing... time will tell."

Still waiting on that Wasteland II novel from him that's been coming soon for 8.5 years.
Would have been better to do without statements completely, since something like that said after such a battle has zero credibility, so wonder if releasing such statements was his misguided request or a pretty clever parting shot from his accusers, leaving a dark could of doubt in a way that won't give anyone any grounds to accuse them of it. And the initial news is indeed ambiguous.

Hardly imaginable.
That's what you get for having a societal (vigilante) culture that effectively allows for the opposite of innocence before proven guilty.

I'm so glad I'm already married and (hopefully) won't ever have to be in the marked for a girlfriend. I'd rather be alone than waiting for society to actually hold such people accountable for their heinous action.

Anyway, would love to see him involved with the story of some game in the future, but Techland will still never see any of my money...

I'm glad to see some closure to this at least, even if it's extremely petty. False accusations are terrible no matter which way.
He was part of the System Shock Remake/Reboot/Whatever by NDS but he has been officially left out ot hte project since 2017.
What now? Is he good enough to make a come back?
Seven figure payment? I somehow doubt that covers all the potential money he could have lost because of this shit. He probably let them off easy, as he just finally wanted the harpies off his back.

The statement is also one of the most laughable things I've ever seen. "We accused him of rape, but not ACTUALLY, DUH!!!!. We just wanted to raise awareness of XYZ, you see...". Like what?

The mental gymnastics that other communities are doing trying to still blame him and to avoid admitting they're wrong is astounding (resetEra, Eurogamer, etc).

Hopefully he'll be able to go back to his career - just sucks it's so easy to destroy someone's life with made up stuff.
Didn't catch much of this storm back when, but am glad he finally won out, seeing as he was innocent.

The statement by the "defendants" read like utter tripe and lies, tho. WTF. If that is the statement they wanted published, it would have been better to say nothing.

How did it hurt them? They weren't really punished and I doubt they have the means to pay him. He doesn't just magically get the money. There was a good chance that he could have ended up in prison. There's no way they would have. Some people will always assume he's guilty just because of the accusation. Females are almost never punished when they lie about things like this. "If we punish them for lying, it could keep females that would be telling the truth from reporting someone." Society treats them and certain other people like they're misguided children. Males are always thought of as guilty, even when they aren't, after they've been accused.

Just so hostile this entire "love-environment"; I bet if we continuing like this in "the west" then soon we will have so few real familys and childrens... we may slowly go extinct. Maybe not even worse because at some other nations, not from "the west" there is still enough of value for family, love and true friendship... i guess we are doomed, but the true change come from within ourself.

Most of the accusations, in my mind, are made in order to gain someones "power" and unfortunately, men with high power are vulnerable to this behaviour; especially in the US. The society is just way to much based on "success" and "might-related-matters". I find it very important cultivating true friendship, true love and ultimately lowering this excessive "sue-mentality"... which i think nowadays it will in general cause more troubles than anything good.

Indeed, it is difficult not coming into contact with the "wrong people"; instead able to meet the "right people", because the right ones are somewhat so few and hard to find. I just wish for everyone (including me) able to find the right people... then we may have more peace, harmony and ultimately, true love.

I mean, even if you do not love someone; you would never try to hurt someone in a way that will basically "ruin his life to a big extend"... this is really exactly the opposite of love. Even ignorance, the complete lack of any feelings, is sometimes the better deal but as long as someone else got some gain by NOT ignoring someone... they usually may chose not to ignore. We are as humans pretty much "gain-based" but as a individual it is very hard avoiding this mentality because the society is almost "blood-soaked" by this poisonous mentality. So, not much can be done about it, simply have to find the right people... i do recommend someone else without "social media" (this is one of the biggest love-destroyer, unfortunately) and hopefully somehow it may become solved. We simply do not live long enough in order to create a obstacle to each others... and still... some people apparently are taking their sweet-lifetime causing nothing more but troubles. I just recommend... do never meet them, guess better to stay allone, in term no "true love" found.

...in other words, sites that espouse the very same toxic ideologies as he himself does and which are 100% members of his very own ilk. Ergo, I feel no sympathy whatsoever for him. This stuff happening to him is exactly the bad karma that he has earned for himself.
