it's a problem with the gog downloader, see this thread:

if you just use the old style of downloading (so just html download), it will work. (with the risks involved ofc of downloading such a large file at once with no chance to correct stuff that went wrong)

That annoys me as well I haven't even been able to begin downloading as the GOGdownloader won't open properly and the first manual download file is corrupted. I know I'm running windows 7 but even with administrative clearances and compatibility it don't work.
Now the game is downloaded with the GOGdownloader but I'm having a supposed install problem because when i try to launch the game I get a system error saying The program can't start because d3dx9_35.dl is missing from your computer. Try reinstalling the program to fix this problem. But when I do that i still get the same witcher.exe system error!
