Not sure about every country in Europe but in my country EULA's aren't valid at all as they've been giving
after purchasing the product (which is forbidden here by law). They've never changed anything about that too lol.
Which is not all the case for this game because the Eula is giving on the store page already. ;-)
What you seem to be refering is a specific case with microsoft and a few other companies which went before a german court and declared that customers have the right to cancel the contract with the retailer IF they did not like the eula. That's it.
The eula itself was not even declared invalid, only parts of it, but customers are free to return their software to microsoft after purchase within a reasonable time frame if they decide to decline that eula.
Does not apply at all to products with an freely avaible eula before purchase.
