I have bought mm9 from gog.com I beilieve it is possible to get through it if you install a patch 1.2 version but I cant install it. How does one install the patch?

I have downloaded but it wont install and it gives this message:

Old file not found. However, a file of the same name was found. No update since file contents do not match

it seems it was the upgraded version that i did have at least it says 1.3 in the menu window of the game but when i create party i cant go from the first character to the second and I can only choose skill points etc to the first in the party. Does anyone know about this?

If you see, the cursor is at the 1st person's name box. Press Enter, then you can press Tab to switch to the next person in the party.
