Am finishing act 2 slowly, and the prison is getting quite crowded. I've convicted and burned the big baddie, which brought me plenty of xp and levelling. However, there are still a few prisonners that I have proven guilty, and are stil in jail. Burning them brings no xp, so I wonder - is it still required, to advance the plot, or can we just keep them in jail ? Does it make any difference further down the line ?

I think you have to burn them all to get on with the main quest. But I'm not completely sure.
