The details aren't out yet. There is some precedent in how it might work, since you can currently transfer purchases from a DSi to a 3DS. Unfortunately when you do that you no longer have the purchases on the DSi.

Given Nintendo's track record, I wouldn't be surprised if they failed to offer any solution.
