Sony:"WTF DO YOU MEAN YOU'RE TINKERING WITH THE HARDWARE YOU BOUGHT?! YOU DIDN'T BUY THAT WE JUST RENT IT TO YOU! NOW STOP THAT AND HERES YOUR LAWSUIT STOPPING YOU GETTING ANYTHING FROM US IN THE FUTURE!!11"
"IMPORTANT: After the Nintendo 3DS system is updated, any existing or future unauthorized technical modification of the hardware or software of your Nintendo 3DS system, or the use of an unauthorized device in connection with your system, may render the system permanently unplayable. Content deriving from the unauthorized modification of the hardware or software of your Nintendo 3DS system may be removed. Failure to accept the update may render games unplayable."
You also miss the controversy at the 3DS release about the console logging all the games you were playing on it and being, theoretically, able to detect if you played unauthorized games and, in such case, brick itself. (Honestly I don't know if it ever was anything but a threat from Nintendo and if they actually every did it).
