Here is what's wrong with the results of the suit (my opinion only - IANAL). The jar doesn't say that it's healthy, at least not on the jar we bought. What it says is, "An example of a tasty yet balanced breakfast: a glass of skim milk, orange juice and Nutella on whole wheat bread." In fact, most of its numbers are better than the "healthy" Smart Balance brand peanut butter I just put on my toast for breakfast.

I guess we should all sue the makers of Smart Balance peanut butter.

So I don't see anything wrong with the breakfast; Nutella is low in the bad fats, has very little sodium, and has fiber. Second, if the taste of the stuff makes it more likely that one will enjoy, and thus be eating, the other healthy components of that meal then I don't see that as a bad thing.
