You can't just cite fair use for everything out there. Unless it's for educational, informative, documenting purposes -- it's not, GOG's usage is to promote themselves --, fair use does not apply.

Of course not for everything, and the test isn't whether it's educational, informative or for documenting purposes, it is whether:
1) The party isn't readily identifiable without the use of the mark (the game developer)
2) The mark was only used as much as required to identify the party
3) There is no message of endorsement by the mark holder
That's the test for the US.

I cannot remember the EU defence, but there is certainly no infringement in this case.
