amok: if they said clearly that the first 1000 buyers get it, then no he do not have any basis for a refund.

But I do not know what the wording on the page was at the time, as I was only aware of the new bundle about half an hour after it had started, so I do not know how it presented at the time.
Humble knew at the moment of sale whether or not the purchaser would receive a particular game. If the last impression Humble gave to the buyer was that the game was still on offer, and then did not share available information that it was not, that's intentionally misleading. Still, we seem to agree that it's a deplorable tactic, so I'm happy enough to leave it at that.

nijuu: Indiegala got into the act as well at one point (i think - ill have to check)...
Yep - IndieGala Limited. :p
I'm not thrilled by this HIB.
What games do you think will be added in the second week? Terraria and Joe Danger 1 are a given in my opinion.

I already own To the Moon and the two games from the BTA tier. But DRM-free Papo & Yo is quite a nice surprise. Will buy the bundle for this one alone.

Seriously doubt Terraria is going to be just an addon....

I thought Surgeon Simulator 2013 was goofy fun; Runner 2 is good, but not quite as good as the original; I really didn't enjoy To The Moon, there was some nice music though. The others I haven't played or played enough to really judge.
Humble Bunde's approach is unique in it's pay first then see if you got what we seemed to offer initially because it required payment to process before you could "claim" the 1000 Starbounds. At least with other limited deals you could confirm and know what the purchase would contain before committing.

I don't think limited quantity deals are automatically a bad idea; Indiegala's limited bundle had sufficient availability that although "limited" it was accessible for anyone interested. The problem is with sales of obviously inferior quantity versus number of purchasers. Humble Bundle has 38150 sales within 3.5 hours, so a 1000 limited deal at $9.99 was always unreasonable. In general I liked GOG's Insomnia sale too (although the GOG free games were absurd).

Screenshot of the HIB sale. With the everything, but the quantity of sales and Starbound as they were when it began.
I have it sitting on my tablet still because I feel $5 for the whole lot is okay, but I now always give them a few hours to see if the price plummets.

I do not go in on limited sales where I could give away money for nothing, at least with GOG's insomnia sale, and IndieDaily you knew / know when you enter the payment screen if you are getting the limited game.

I managed to grab Starbound.

Too bad the game crashes as soon as I try to leave the ship.. :(
Apparently Humble Bundle retroactively added Starbound to some purchases made just at start of sale. I got the following e-mail:

"Thank you for purchasing Humble Indie Bundle X! Your purchase was processed right on the cusp of when we ran out of our 1,000 Starbound keys, but we were able to secure you a copy. Head to your purchase page to find your copy of Starbound..."

That's very cool of the Humbke Bundle people!
This is what they banged on about in teasers for months?
I cannot say I'm too impressed. Might not be a lot of repeats, but still pretty much an anticlimax to the hype they bestowed for many. For me, maybe To The Moon. Maybe not.
Meh. The only thing that would really interest me is Starbound and obviously that one's out of the picture now. :P
i miss the starbound dayum :(
late for purchasing..

jamotide: Hehe, 5 grand for a stupid joke, that is class!
Now the top contribution is $ 1250. Apparently they don't accept money from scum. Good move.
