What if they did send a letter and 3D Realms ignored that? The original site hinting at the game's announcement was unveiled about 3 weeks ago; plenty of time for them to do that.

That's possible, but I'd be surprised. Plus, this project has been around for quite some time, IIRC about the time that DNF was finally released. If they took issue with it, that would have been the appropriate time to take action over it.

According to this article, the game was officially announced as Duke Nukem just this month, previously being known as "Project Ascender".

Hmm, perhaps I'm confusing it with that other DN game that was in the works since 2010. I guess I'll revise my view as more information comes in.
