While true, you didn't mention how much it's been (ab)used for marketing reasons. And honestly: an enemy shot in slow motion with copious amounts of gore hasn't anything to do with creativity. But a lot with getting press.
Acting against censorship is one thing. Being critic about what and how the industry is trying to sell their products is another. Somehow, somewhere, the second part got lost.

That has nothing to do with the Constitution itself; that's righteous assholes managing to get their way despite what the law of the land says. And the bitch of it is even the authors of the Constitution were assholes who wrote about equality and freedom and then still pulled the shit they did with women and minorities.

That sounds about right. I couldn't really think of a good way to respond to that so I just didn't.

Also, it doesn't matter whether someone thinks an enemy shot in slow motion with copious amounts of gore has nothing to do with creativity, it's fucking awesome and much better than some of the shit we can see in movies that consist of real people, though actors, pretending as hard as they can that they're in pain.

Copious amounts of gore is rather vague, it can actually be a realistic depiction of blood and flesh ejected through an exit wound which would probably put this on roughly the same level as the slowmo face punch from raging bull that everything ever involving boxing has ripped off or it could be a ridiculously over the top instance where the blood goes pssst in slow motion, the victim turns to the camera covering it in blood which then drains off forming the title of the game which would put the scene on roughly the same level as 70s schlock horror
