However, if Interplay did not honor their contract and did something against what they should have done, then Bethesda has every right to sue.
On a side note, am I the only person in the world who actually likes Bethesda and Fallout 3? :/

So no you aren't. But there is a small extremelly vocal minority of Fallout fans bitching whenever something changes here.

The only time I felt ashamed to be a Fallout fan is when I went to the NMA forums. They struck me as a bunch of elitists, and generally acted like pricks to anyone who said anything positive about Fallout 3. I've yet to see there level of rabid fanboyism here, but it still surprises me since I think Fallout 3 was a solid game, and at least Bethesda got the license to do it. Image if Ubisoft or EA got hold of it.

No, you aren't the only one. But whenever someone mentions them, those who like them don't feel compelled to derail the thread to profess their enjoyment, or every time there's a new item, they don't feel the need to create a thread to remind everyone that they thought the game was good. Only those who hate them need to indulge in unwavering jeremiads.

I love all the fallouts (well 1,2, 3 - haven't yet played tactics). FO3 has its flaws but I have spent a lot of time playing it both modded and unmodded and plan to get the GOTY edition for the DLC.
I have seen the "trilogy" in the store lately and it does look confusing for those who don't know. And if you buy it are have never played an old school RPG, but played FO3 ... I can certainly understand Bethesda's POV. Who knows about the legalese.
You mean suing over an MMO Interplay would never, ever make based on their track record?

Until FO3, fallout was pretty much a dead IP. Yes there was a dedicated fan-base, but outside that fan-base few had heard of it. In fact it was after I heard about FO3 coming I decided to buy and play FO1 & 2 . I had heard of it but had never played it although did play Wasteland before the dawn of time.
Try as I might, I can't find a pic of the box version I know about. Next time I see it, I'll find the publisher info on the base and see what I can turn up from that.

If you're referring to people like myself, then that's just being stupid. Calling others "gems of evil" or using the word "bitching" just because others have a different opinion on how the changes don't make the game better over its predecessors is petty.

Agreed, though the NMA forums have improved generally over the last few months. Not by a mile, but you can definitely see a difference in the quality of posts from 2007, and in 2009.

If Interplay sold off the rights to the name (which does seem to be the case) and then still tried to profit from it, they're blithering idiots.

Honestly guys, it's highly doubtful the items will get taken off the market considering they are Fallout 3 goods selling well. If anything the profits will get turned over to Bethesda.
With that said, dumb ceos have done some really boneheaded shit....
But in all honesty, if Interplay sold their Ip and then profited from it, that is profit that Bethesda deserves, so a judge would give the profits to them.

I also seriously doubt that it will be taken off the market; particularly GOG since here they are being sold separartely.
I think part of the problem is the previous bundle was called "collection", while the current bundle is called "trilogy."

Its clearly Bethesda using all of its legal power to get control back of the Falllout IP; since interplay was selling something they no longer owned and not living up to their agreement with Bethesda. They have to say things like irrepariable damage because a lot of the law requires damage to have occured. Clearly this is just extra fodder in the MMO wrangling.]

Looks like the suit is based on a mixture of trademark infringement and the specific contract between Bethesda and Interplay, so I'm guessing this lawsuit is going to be a pretty big mess. Trademark infringement cases, on their own, require quite a few conditions to be met in order to be successful, and I don't think there's a clear case of trademark infringement to be made here on its own. This leaves the contract between Bethesda and Interplay, and while it sounds like Interplay did violate some terms of that contract it's difficult to speculate further without seeing the full contract. It's also a complete unknown what action a court will determine to be a suitable solution, or if it will even come down to a court decision (I'm personally placing my bets on an out of court settlement after the lawyers go a few rounds).
