Abandonware and freeware are different BTW. Freeware is when the person who owns the rights of the game has specified you can download it for free. Abandonware is when the owner is unknown (due to publisher being closed down or something along those lines) and it is put online for download without owner's consent.
Majority of Abandonware is illegal.

Correction: All "Abandonware" is illegal, otherwise it wouldn't be classified as abandonware. (It would conveniently shift to freeware.)
Point is abandonware whether the original company is still operating or not is illegal. Ethics you can debate till the world explodes in 2012.

I just didn't want generalise...some sites count Shareware games as Abandonware.

Shareware isn't abandonware then. It can be legally distributed.
