Seriously guys, cool off. It may not be a ruling we like, but that does not make it part of some worldwide conspiracy of a global NSDAP meant to bring about genocide. Let's take things in proportion, shall we?

tremere110: I find Goodwin's Law offensive. It involves Nazis in some form and must be removed from this board at once! :p
Totally agree. Nazi stuff is way out of mein kampfort zone.
I couldn´t resists posting:

A lot of people writing here against freedom of speech, just write rubbish, sorry no other way of saying it.

All those forums you are relating too are NOT public, they are private.

Remember you can´t shout fire in a theater, if there is no fire.

THAT is exactly what this ruling is about.

Nothing else.......

And as others pointed out, it is keeping in mind the horrible case, where a teen committed suicide because of bad postings/messages and the responsible web side did NOT take action.

And the notion of free speech, for all of you complaining: You never read the user agreement, EULA what so ever??? I assume?

Hate speech is always forbidden, for good reason, it is ONLY, if the company behind does not react. Which funny enough, by normal criminal law in most states you would go behind jail, for knowing about something like this. SO companies are getting of light, despite what a lot of people are claiming.

If you don´t believe read up on hate speech.

for a starter:

Forums are not public places. Unlike the speakers´ corner ;)

Just my 2 cents of reasoning ;)

Emob78: Well, when tyrants begin their wheel of death, they rarely start at the end-game and work in reverse. Hitler didn't start out on the streets of Munich trying to sell discounted gas chambers. His rhetoric was couched in 'da jewz took our jobz!' and then baby stepped it until he had enough power to begin the mass culling.

Same thing here. These PC laws start with 'let's go after those ignorant racists who deny the holocaust!' and proceed from there to tax protestors, animal rights groups, various religious sects, and ultimately... well, people who just complain about video games. But once that engine gets cranking, sky's the limit. In the end we either ALL have freedom of speech, or none of us do. And these European court rulings make it clear where the men in powdered wigs stand on the issue.

I hope you're right. There's enough wanted lists as it is. The last thing we need is a bottomless pit of 'most wanted internet troll of the week' lists being broadcasted across the holonet.

I think the slippery slope fallacy is granted an exception in terms of law. Like legal Precedent for example ^_^

Every new stupid law needs a measuring stick. When E disappears, it's time to hide the kids and wives and make a bee-line for the underground. E will just have to fend for himself with political pamphlets and homemade kung-fu.
i'm not a troll and I really don't appreciate being called one. :D

theslitherydeee: Big brother was the figurehead of the government in the books.
Just the image people were united under. What I'm trying to point out is that everyone misses the excellent horror twist of the situation that makes it so dire. It's not the man behind the curtain or the oppression by government like people keep on using it for.

All us of at one time or another are trolls in someone else's eyes. For my part, you have never been a troll. Maybe an ogre or a goblin, but never a troll.

immi101: defamation and hate-speech are not protected as free speech. if a website owner gets knowledge of such a user comment , he has to remove it.
Not sure why that is controversial? *shrug*

if you think that won't allow you to voice your opinion anymore, you might want to rethink the way you participate in a discussion :p

gunsynd: If I can't say what's on my mind or have an opinion without penalty, then what's the
good of free speech?I understand certain things are taboo and usually stay out of
it,unless I see something wrongly stated.Oh well, this is the future and it's been
coming a long time and nothing I can do to alter it.
stop for a moment thinking about your rights and think about the rights of the other humans around you.
your right ends where it violates the rights of somebody else.
The right not to be subjected to attacks upon ones own dignity, honour and reputation is one the most sacred values we have. If you put that right against your right of free speech, free speech will loose. And that isn't really a new development. It has been that way since before the internet even existed.
try look up these two rights in the human rights charter and note which is listed first ;)
The ruling is about hate speech; racial, homophobic and misogynistic abuse and bullying.
At least that's my interpretation of the article.
There's a big difference between the occasional sexist joke and hate speech.
So I think people are over-exaggerating the consequences of this ruling.
Unless someone starts spreading neo-nazi doctrine on this forum there's nothing to really worry about.

Yah, no one has anything to worry about. Those are concrete terms with clear definitions which AREN'T normally twisted around to label entire groups of people.
Seriously, I hope they define the terms. Not doing so is just brainless.
If this continues, free speech WILL be curbed drastically.
I guess the good side of this is that steam is finished.
This is the reality in Germany since forever and has nothing to do with grinding down your rights of free speech. "You fucking idiot! I'm gonna beat you up and pay twenty HIV positive junkies to butt-rape you!" is NOT free speech. Posting nudies of your ex is NOT free speech. Offering weapons and drugs is NOT free speech. These things are crimes in the real world, so they're crimes online too. If you, as a website owner, don't give a fuck about this, you're offering criminals a place where they're welcome to commit crimes. This does NOT mean that the people who commited the crimes are not responsible for them. It only means that you are seen as a person who supports them. It's your house, so keep it clean.
I read the whole artilcle, and the more Iread the more enraged I felt, because it showed more and more that the EU has become a clear cut case of the right hand having no idea what the left hand is doing.

There is a separate court, which defends freedom of speech and e-commerce and has previously ruled that a site CANNOT be held accountable, nor forced to monitor its users comments.

And then this bullshit happens.

Fucking shit for brains idiots that can't even begin to be conherent among its different branches.

No they're not, because the problem here is the varying measures and approaches people and organizations take as to what constitutes hate speech. Those are not specified and they are prone to abuse.

And then there's the bloody whiny SJWs of the world.

A recent case, someone made a black humour joke about the holocaust. Even if the poster meant it as an example of crass and cruel humour with no further intentions, there's a 100% chance that somebody, somewhere will cry outrage and become offended and demand it be taken down and measures taken against both the poster and the site.

And that's what they're afraid of, how do you tell when someone is being truly virulent and hateful as opposed to being simply crass and tasteless? Depending on the lawyer, the difference is the amount of the settlement.
