They could have. In the first game a scientist even mentions how strange it is that a force with such advanced technology just didn't outright conquer the earth. It becomes clear at the end of that game why the aliens didn't.

In the second game the aliens need the commander alive to complete their plans. The death of the commander would doom the aliens so vaporizing the avenger is out of the question. The commander could of course kill himself but then what's to stop the aliens from exterminating all life on earth in revenge?
