Good day,

I would just like to know if there is any way to sell one's games second hand? Or if it is possible to sell one's account?

Thank you.

Possible, but legally a grey or dark area and definately something GOG doesnt support or condone. The likelihood is that if GOG finds out the account would be deleted. Which in turn would make you a scumbag for knowingly making such a transaction.
You can't sell games, because DRM-free means people could simply keep the offline installer after selling the game.

Selling your account is also not allowed by TOS (perhaps for the same reason), but of course GOG has no way to tell if you did, since you can shop here pretty much anonymously (using some anonymous email account and Paysafecard).

If someone's email, IP, geo location, and payment information change all at once, it's very clear to detect such cases. Whether GOG bothers to monitor them is another matter, because GOG really doesn't lose much if an account changes ownership.

Of course there can be cases where someone moves to another continent and stuff like that, but even in those cases at least some personal information should usually remain the same.

No. This would be a breach of 11.1.h. of the GOG User Agreement (https://support.gog.com/hc/en-us/articles/212632089-GOG-User-Agreement?product=gog). Breaches of 11.1. are specifically called out in Section 17.2 as a material breach of the agreement, which could result in suspension or termination of the account in question.

GoG provide games DRM free. Please don't abuse the trust that GoG place in us as consumers by abusing the ability for these games to be illegally passed on to others as it damages their ability to provide games DRM free.

Like I wrote, with some throwaway email address and Paysafecard only the geolocation data is left. And that isn't monitored I would guess - people access their GOG accounts from abroad all the time (at least I do, when there's no pandemic lockdown...).
Yes, but only for Dogecoins.
If you "sell games" as you put it and in the manner you are suggesting, VWood, that that is extremely illegal and very likely to land you in prison for a very long-time.

get used to it costumers have rights to resale their license if they feel like it
consider GOG is within EU they should know the EU laws and act on it

anyway do corona this case is still like years away of being resolved.

Yes - the case is subject to appeal and also contravenes a previous German case on whether it's legal to re-sell your digital games (the German court upheld that it was not a right under EU law).

I'm no expert in the French legal and appeals system, but my gut feeling is that the French court's interpretation of the general EU freedom of provision of services within the EU taking precedence over EU Copyright Law (which for digital and streaming services broadly states that every use must be subject to the authorisation of the rightholder and copyright does not expire with the first sale, unlike with physical goods) is highly likely to be overturned by appeal. Currently, and assuming it hasn't already been overturned on appeal, this legal ruling is confined to France - it isn't automatically adopted within the legal systems of the remaining EU27.

I would expect that even if Valve lose in the French courts, they will escalate this to the Commission and ultimately that EU law would be clarified to make it clear that there isn't a right to resell.

I actually find the ruling the French made to be pretty troubling. It's not exactly a good thing for a DRM free provider - the ruling the French made basically said that you could transfer a licence provided it's the original copy, and not of duplicates. Good luck checking that without DRM based activations (i.e. the ability to ensure the seller loses all their access to the games they have sold).

You could resell a license or licenses you purchased for a game. After selling it you must be able to transfer that game or piece of software and have to delete it and backup copies from your account and drive or drives. This isn't possible on Ubisoft, Steam, EA, GOG ... GOG doesn't sell keys, Steam does. Since you can't sell a key/license to access and play that game once activated nor transfer it to another person's account you aren't able to make use of it.

If it was possible to resell your license to anyone wishing to purchase, with or without an account, they would end up receiving an inferior product with no access to current and future patches, updates, DLC. Not to mention that without games officially added to their library, they wouldn't be able to enjoy Multiplayer (or single-player online content only accessible via Galaxy, Offworld Trading Company for instance) and no achievements.

If on the other hand it was possible to wholesale an account, which it is technically by selling your key and username to a third party, they would still not get to enjoy the full experience. Since it isn't possible to reset achievements that person will not be happy with their purchase.

To make use of this apparently legal option to sell a license an online shop would have to implement the necessary infrastructure to make it possible to resell within legal bounds. Unlikely that any one shop can be forced to introduce such infrastructure by means of law.
GOG accounts and games purchased on GOG are for your personal use and selling them is against our User Agreement which you accepted when registering on GOG.

More details can be found in point 11 of our UA:

Since it's clarified, I will close this thread.
