I have tried everything. Changing to the 3D Driver Hardware TNL thing, all compatibility modes, running in lower color modes (16 bit), lower res windows, running as administrator and I have tried te neoee patch, which did not work. After a normal install, the game functions fine, with just graphical problems. It looks as if the screen is trying to tear apart, constant flickering and ripping motions. I have intel graphics I believe. This is driving me nuts.

Alas there is no way to get EE working as far as I know on windows 8, although I've heard registry editing might help.

It does work on windows 8, but not for all. It does work for myself.

It's too darn bad too, oh well. guess i will tide myself over with Empire Earth 2, Rise of Nations and Cossacks.
