To get the mouse to stop lagging in Windows 8.1 use the fix MS provides in the link (Warning you will have to fiddle with the registry).

I don't get mouse lag in Win 8.1, is this a hardware specific thing?

If you are using a mouse with a high (1000+) polling rate you are more likely to be affected. However, MS has released more patches since I posted this, so, there may be no more problems with running this game on WIn 8.1.
