The game starts alright but the menu lags slightly. The fmv plays alright but when the game starts it lags to the point of unplayability. My mouse moves really slow and I cant move my character at all. Im playing on a Lenovo y510p.

Yep, that's because Win 8 is not officially supported.

Following exactly this solution works pretty fine for me and makes the game playable under Windows 8!!!

The game was unplayable in Win8 before.

First the graphics were totally broken so I couldn't even recognize the game menu.
Not sure what fixed this but after having installed old DirectX Versions 7/9 in the meantime graphics suddenly worked.

However, mouse movement in general and animations in the game are deadly slow making the game UNPLAYABLE.
The recipe using DXWnd fixes this problem.

The only downside is occasional flickering and told of but yet unexperienced occasional crashes.
Still, the game was made playable.
