Since GOG promises are as part of it's spiel that you can "download games you own anytime", and now there are 3 games that we CANNOT download anytime we want, will GOG refund these titles?
Additionally, if we cannot get a refund, or if users decide to keep the title, will it show in the virutal collection (Shelf) after the title is removed?

Nope, no refund (you CAN keep the game, of course)... and I doubt we can keep the box on the shelf, unfortunately, since they have to pull all licensed material, which would probably include boxart.
I wonder if we can have some substitute, or fanmade boxart that we can keep in our shelf instead? I'd hate to see a whole virtual box just disappear...
See, I don't agree with this. I feel that I have been denied what I paid for...if I cannot re-download the game at will, I feel GOG has broken their end of the contract. Yes, it's only $5, but it's the principle of the matter.

a) The "download service" isn't a part of a contract.
b) even if you disagree, the ability to download is only a tiny percentage of what they're offering. A refund for that would only be what, a nickel?
c) No refunds IS part of the contract - or terms of service you agreed to.
d) this has been discussed already.
e) It's out of their control.
f) It's definitely never been in OUR control.
g) It's probably been discussed already.
h) There is NO point h.
I suggest you take some time out and just enjoy the game!

Operation Flashpoint was the only other GOG title that was removed from the catalogue that hasn't returned. Unfortunately I did not buy the game so I'm uncertain if you can still download it or not.

Well, happily *I* have an official source that has told me *otherwise*. I happen to know that this issue WILL NOT hinder any current Toca/CM owner in any meaningful way. I cannot NAME that source, but I HAVE one. I no longer have any worries about this situation, my concerns have been allayed tenfold.

Told you otherwise... you mean there IS a point "h"? How embarrassing. I'm going to have to go back and change all my notes.
I'm very glad to hear of your mysterious insight there, though. Thanks for posting what you did. Of course, my copies are backed up all over the place so I wasn't too worried.

Yup, there is a point H. I have it on authority from a source I was told not to reveal that the TOCA/CM problem will *not* affect GOG users in any menaingful way.
The worst case scenario, based on my understanding, would be a refund for those who did not back it up, IF it's ever remvoed from the virtual shelf. IF.

Good to hear. I know point "I" is completely unrelated to GOG, or gaming for that matter (it has to do with metal containers, combustible materials, small children and all that stuff). But I hope point "J" still stands...
That's kinda lame.....I would think a company so serious about treating the consumer right would offer a refund or credit.
anjohl, are you saying that you were told you'd still have the right to re-download your game...it just wouldn't be advertised?

I don't remember seeing any announcement from GOG but it would appear that they were successful in still being able to host the files for those users who purchased it before it was removed from sale.

Last time I asked support, they told me they were still negotiating and couldn't give a proper response over the subject of the game's download availability in the future. But, it would remain there until they could come to a definitive resolution. It's been some time since I asked though.

I still can download it anytime I want (as long as my internet connection allows me to :-) ).
If it stays that way and they just don't sell it anymore, it's all fine, I guess.
At the very least I'm sure that if it ever came to pass that for certain we could no longer download the game they would send us another email or something. I can't see them just making the game disappear from our shelves. I believe that they care about their end users.
That said my files are still backed up on a disc.
