Does the disc tray really open by keeping the damn button held down?

Not as far as I remember, no. It took a second or so to register and slide open, I think, but I never had to hold it down.
nope maybe unless you have a faulty player.

also handy to replace the harddrive and ftp stuff to it :)

No, it is enough to push it once.
Replaced my DVD player on my old Xbox recently, really easy thing to do.

If the tray isn't sliding out you may have a bad part attached to it. Turn the xbox off, then carefully pull the disk tray out by several inches. After that, turn the system on again. If it retracts, the tray was stuck. If it doesn't, there's something wrong with the mechanism for it.
I ordered a used XBOX for my little brother from some guy last week, it came on Friday. Unfortunately I don't have a TV here, and I never had an XBOX, so I just turned it on to see if it actually works. The disc tray did not open however, and I contacted the seller, who gave me an address to send it back as a defective item and I sent it on Saturday.

He contacted me again today and said that he received it, he tried it out and the tray opens by keeping the button pressed and that he can give me my refund but not cover the shipping costs I payed to send it back. My brother still wants the XBOX, so I'm torn between what to do. I'll probably order something else from him to partly pay the new sipping costs and cover the costs I incurred.

if it requires being held down it's a faulty connection and as such broken it's up to you if you want to argue it with him though
There are guides online you can use to pop it open and try and fix it. They've been around a good while, largely because of the PS2 failure rates prompted the need to get consoles open and see what the problem is. That is, if you decide to take the console back.

I came across my old xbox a few weeks ago and decided to order Ninja Gaiden Black (absolutley loved Ninja Gaiden) and Sudeki for it......two days after I got them it box crapped out on me. :< :(

If it was sold as working then you're entitled to a full refund including postage (and the cost incurred sending it back).

but it is still working, you can play games with it.

in general its never a good idea to get a console through the internet. i always bought them face to face.
I still have a functional Xbox sitting under my bed in a box. Never really liked that console, but I can't seem to get rid of it.

mostly this, actually, the seller has either the right to repair it or to send you a new one. Whatever he does, he does have to cover the shipping. Usually you can't demand a refund until he ultimately failed to fix the mistake. That is EU law, so UK law might be different in the details.
