I still don't get why GOG actually set up affiliation with them. GOG really should set higher standards for themselves.

Remember guys, in most cases the cracks are perfectly legal. Especially if a game has invasive DRM, since, at least in North America you are allowed to modify software enough to make it usable, and sometimes that requires removing CD checks.
Distribution of said software not so legal though.

Can someone tell me why this matters? I ask this every time some publisher uses a warez crack to remove the DRM from the game, but no one has given me a good reason.

Because they don't give attribution to the crackers. Might be an authorship infringement by the publishers but I surely don't know about the paranoid U.S. law. They just should keep their ACTA at home if they need it at all.

IIRC, you can't sue in defense of something or claim ownership upon that violates the law. These cracks violate the DMCA by removing the DRM without the consent of the publisher. Furthermore, you also can't claim ownership, unless it's in the public domain, on something that you modify without the owner's consent. If I took the first Harry Potter book, changed every instance of the word "the" to the word "frog" and tried to enforce copyright if the publisher took my work, I would get laughed out of court, with good reason.

Yeah. This is a non-issue. [See my response on codex thread].
On the other discussion: As much as I disagree - politically - with codex (and I always have, despite donating to the page way back when it was a little more focused on quality content), I do think it does have a purpose. Less now than it used to, maybe, but there is, among all the drivel, valuable discussion.
