I call bullshit on that. In order to buy it you need to pass the DRM based check. Sure if you're going to pirate it the DRM doesn't apply, but when does DRM ever apply to pirated materials?
And my point stands that if they pulled it to fix the DRM rather than releasing it without DRM, that sort of implies that DRM applies, now doesn't it?
And really, that's sort of like saying that the entire game is DRM free when you can launch it without after you've run it past the checks. The DLC and the game don't work if you don't run it by the DRM first.
EDIT: And what's the deal with getting stuck in a mountain, yo. I had to back up to a recent save because I jumped into a mountain and couldn't get back out. Most annoying bug I've encountered yet. Although that they didn't bother to fix the VATS non-shooting bug is up there with that.
