I, too, blame Interplay, but I really have to wonder how Bethesda thinks the sale of the 'Fallout Trilogy' has impacted their sales and done irreparable harm. That just boggles the mind. But Interplay should have provided Bethesda with the required packaging, advertising, and promotional material as per the agreement (presumably they didn't).

It depends, GOG has assured us that we'll still be able to download games even if they cannot sell it anymore. This promise can fail if the game uses content that is only licensed for a limited time (such as TOCA3 and Colin McRae Rally 2005 using real-life car manufacturers and models... although I still see the games on my shelf, so I'm not entirely sure what's up with that), but seeing how the Fallout games doesn't seem to fall into that trap, I'm pretty sure we'll still be able to download them.

Beth does not get cent from old Fallout Trilogy, thats why. Also playing original Trilogy have made many people realise what peace of crap Beth so called sequel is so more complaints. But mostly it's realisation what money maker they missed when they did not get original distribution rights in the deal.
It was pretty much sell or sink situation. Even selling most of their IP kept them barely afloat.

If it's Bethesda's IP now then Interplay doesn't have a right to sell it without Bethesda's permission, no matter how much anybody despises the new game.

Some people may not know about Fallout Tactics and all the relatively old corporate shuffling in the industry, and so assume that a trilogy includes 1-3. When it doesn't, they could even get made at Bethesda. But the basic point is that Interplay seems not to have fulfilled their end of the contract.
And for us here, the important thing is to buy any Fallouts you don't already have, download everything, and make several backups.

If court order ordering halt on sales comes, then yes. It should only halt the sales however so people who have already purchased any of the three games should be able to download it at least until final verdict is passed. If Bethesda wins the part about original trilogy sales, games are probably pulled entirely. Problem is, can Interplay even affort to fight it on court?

I suppose it's not surprising that so many here like to remember when Interplay was competent. Actually owned the rights to its many intellectual properties, and employed the people responsible for making them.
But those days are long over. They've sold the rights and lost the staff. The incompetence they continue to demonstrate only proves why.

I'm beginning to wonder why Zenimax/Bethesda didn't just buy up Interplay and its IP's in their entirety, rather than messing around with this business.
It's not like interplay would have been out of Zeni's financial reach...

I was saying that because it sounded like he was implying that Bethesda owned the rights to F1, F2, and F:T by saying that the Bethesda logo would be on it.

The only reason they let Interplay create an MMO and sell the old Fallouts (under set conditions) was to throw the old company a bone. Hell, they probably thought they were doing them a favour. But the old dog is too lame and should have been put out of its misery then and there. I think you're probably right about that.

Check the legal info on this very site. Bethesda DO own those games.

Clarification: Bethesda owns the trademark on the games, but does not own the games (i.e. the actual code). That still belongs to Interplay, but since Bethesda owns the trademark, Interplay can't do anything with the code unless Bethesda OKs the use of the trademark.
