i may not whole heartedly agree with the length of sentence, however people have to learn to responsibility for their actions. you cant just say and do anything you want, and picking something which is in bad taste is even worse.
we have a lot of problems which this connects and relates to and apparently the only way people will sit up and take notice is if harsh repercussions take place.

Actually, the authorities, especially prosecutors (who get to decide whether or not to bring charges) have quite a bit of discretion. The main cause of insanity like this is because there aren't any consequences for this kind of overreach by law enforcement. The way these things play out is that some concerned citizen (read: busybody) makes a complaint to law enforcement; this complaint may have some apparent merit, or be completely insane on its face, but the result is the same- if the investigating officer does nothing and something does happen their ass is on the line, while if they escalate the matter then they're pretty much safe. This continues at each level and you ultimately end up with the kind of situation in the OP.

On the other hand, if escalation that were deemed to be totally inappropriate resulted in people losing their jobs then you'd see quite a bit of sanity return to the system, but as it stands law enforcement and (especially) prosecutors are pretty much free from any kind of consequences, regardless of what kind of insanity they engage in.

Well, what did he do except for embarrassing himself by making a joke in very bad taste and with little sense of tact, about a very sensitive topic? I don't condone what he wrote and I could understand his arrest if he hadn't made it clear that he was joking*, but apparantly he did so immediately, and besides, the "threat" was clearly over the top, too. If that's really considered a death threat before the law already, Jeff Dunham had better not perform in Texas with Achmed the Dead Terrorist.

Against the backdrop that I've heard quite a few US citizens deride the German ban against using swastikas as a lack of freedom of speech, I find it hard to believe that making obvious jokes, even if in bad taste, should be against the law in a US state ...

Saying that you will go down and murder someone counts as a threat, which is illegal. Even doing it in jest is not ok, unless you can make it very clear that you are doing it in jest.

Not so sure you're right as to the legal definition of a threat, especially when it's as abstract as that. Threats need to be directed to have any kind of credibility. Regardless he really did make it clear that it was not a believable statement, so I think it's fair to say he should, and will, be let out when it comes to the courts hearing about this.
Keep in mind U.S interrogation has a slightly different meaning, which is why we are having extradition issues.

The law may be a bit different in Sweden, but in the US a threat must typically be both specific and credible in order to be a criminal offense. In this case the kid's speech was neither.
