2. How can silence NOT mean approval on abandonware sites?

Can you answer them instead of dodging them all the time?
Is that about whether players or makers of fangames not saying anything? Wherever I go, they'll say a lot against these decisions. Usually however they can't do a single thing because Nintendo. They have a higher authority and power to force them to do that or get fined, thrown in courts, jailed...

Since when has Omega ever done that? I've never seen you accuse him or TinyE or Snowkatt of any such thing before right now, and that seems to be brought on more by the fact that you don't like them saying you should calm down/use nicer language.
In fact, I've seen you use that "you guys are what's wrong with this forum" or the variant of "this is why nobody comes to this forum" before with OTHER people you disagree with. Which I'm sure helps the forum and encourages people to come here.

Since when did he or anybody else defend PookaMustard or LootHunter? All that ANY of us have told you so far is how insanely abrasive you're being. You insult anybody who slightly disagrees with you. All I've done for this entire thread is say that you should tone down your language, and your response to that has been to call them trolls, say they're supporting your new "enemies", and hurl all sorts of crazy insults at them.

Neither; it's my understanding that Nintendo themselves go after fan games in the belief that staying silent while unofficial games use their trademarks and IPs somehow imperils them. Whether that's a belief remotely grounded in reality or not, it's the other side of the "silence is permission/acquiescence" argument. Point being, if we accept that kind of reasoning, we'd likely also have to accept Nintendo's DMCA douchebaggery as being justified to avoid a pretty glaring double standard.

Good thing it is out in the wild. If Nintendo had their way, all the rom's would be locked up - and only a few of them would be made available (only on their own hardware, and at a silly price).

On the contrary. Nintendo's "cease and disist" letters are a clear sign that they are not approving creation of fan games based on their property. Unlike some other companies, that generally ok with fan production.

Out of curiosity, does anybody know if fan games actually detract from company sales or not?
I mean, does the company themselves want the rights to the game, or...?

It's called protecting their mark. People may see a fan game as associated or sponsored by a company, and the company doesn't want anything of dubious quality or harmful programming to be tied to them. Plus, if they fail to protect their mark, someone may infringe it in a harmful way later and use the unchallenged fan game as a precedent for abandonment. Confused yet?
