No. A gift code (key) is a voucher, not the license. It enables you to obtain a license (by redeeming and thus invalidating it). As long as you don't do this, you have no licence.
Also, how you obtained that key actually does matter - if money is involved or not. If the key was stolen or payed with stolen money and was revoked, you have nothing. If you had already used that key to get a license, that license would be revoked to, and you have nothing.
I think you're really trying to cheat the system, and you can scream all you want, it doesn't work this way.
