MysterD: This is more of a mess than the whole Diablo situation was.
Let me explain.
Square (the IP owner now) and/or GOG needs to get the rights to these expansions. There's a bunch of parties involved in this mess.
They (Square and GOG) would probably need to talk to the owners of the rights first and hammer out some kind of deal with $.
DS:LOA might be owned by 2K (who owns Mad Doc Software AKA Rockstar New England - which developed LOA) and/or Microsoft (who published LOA) at retail.
And 2K actually published DS2: Broken World at retail.
The only other party that might need to be talked to is Gas Powered Games, in which that is now owned by Wargaming. So, might also need to talk to Wargaming.
Chris Taylor (who once owned GPG) left WarGamming, so....dunno if he'd also need to be talked to also.

But still, 2K is on GOG anyway... And since as you say, one of those products is already sold in retail, then it can also be sold digitally, even easier than in physical form; no?
I myself would like to finish up the collection and build myself a nice, LEGIT library. Paying a little extra is no problem, at least for me; i want COMPLETE COLLECTIONS!!!
Oh, I definitely get it - you want to own it legit entirely.
Luckily, I have all of this stuff from retail on disc - DS1: LOA Edition (with everything): DS2 base-game & DS2: Broken World expansion; and Space Siege.
Side note: I also own DS3 & Treasures DLC on Steam.
Sometimes, there are different rights for distribution involved in retail vs. digital. And even if different regions, too - there could be different distribution rights.
For example - Some games and/or publishers still might have to use a big publisher or distirbutor to just get in at retail (b/c they don't have the big money $ and/or clout or reputation to get in w/ retailers - i.e. see Square Enix and Deep Silver trying to get original Dead Island into retailers), but could maybe just use their usual publisher and/or self-publish possibly on Steam or other digital channels if need be.
Another example - Sacred 2: Ice & Blood expansion was not released in USA b/c CDV held the rights to all expansions for anything Sacred 2 in USA. Though, in UK - Deep Silver had the rights to everything Sacred 2 and later bought the IP out. So, to get USA rights, Deep Silver went through the whole process and got a deal hammered out with CDV so then they just straight-up released Sacred 2: Gold to the USA (with the expansion). Of course, now - well, looks like a trade was recently made and THQ Nordic will be using the Sacred IP for new Sacred games (since Deep Silver wasn't doing anything with it, after Sacred 3 tanked).
Anyways, all these companies need to talk to Square: GOG, 2K, Mad Doc Software, Wargaming, and Microsoft (if Microsoft are still involved). All probably need to be talked to, to figure out who owns what rights, or if Square wants to purchase all rights out right, or whatever....for both Dungeon Siege 1: LOA and DS2: Broken World.
These things can get complicated - I mean, the whole No One Lives Forever is still up in the air, b/c so many different companies might own pieces of the rights and actual game. It's a mess.
