Not in a legal sense but I guess that the Spiderman games then qualify as abandonware. It's the IP holders problem if they don't want to make profit from their IP but it shouldn't be the customers problem.

jadeite: The PC version of Spiderman 2 is inferior to the console versions, though. Instead of an open world you are limited to much smaller areas.
The PC version is not even a lousy port of the console version, but a whole different game altogether that was targeted to little kids with floating target markers to indicate valid spots for web-swinging instead the free form play in the Xbox/PS2/GC versions.
