Abandonware is not illegal.
In fact I've been running a c64 site with game for 16 years now and even had received mail by some developers of some of those game that they were very happy to see their games on the web and wished me good luck.
It made me very proud as I put a lot of effort into that site.
It was even featured on Italian TV.
It's a grey area and I believe preserving those games mean preserving part of our cultural heritage.
The companies that created those game don't exist anymore.
You could even say GOG is taking those games and trying to monetize those abandonware games,
something that's always been considered dishonorable in the old school scene.
10 "bucks" is a lot of money for cracked games bundled with dosbox. It's essentially piracy.
The term abandonware does not exist as a legal entity. But in any way, even accepting it would exist, (game rights temporally not claimed by anyone and automatically free to download), how could this game be abandonware if nowadays the distribution rights of the game are owned by someone? of course someone that paid for those rights?
Even the "abandonware" sites use to retire the download of a game if that game is sold again.
And of course, some sites preserved a lot of titles and I consider it very positive.
