So I know that turning off HWV gets rid of that odd graphical disaster but once I turn HWV of the frame rate in game slows down to a crawl with massive audio visual desync. Anyone encounter this and or have a fix? Thank you !

Try enabling it again and setting the game's executable to compatibility mode for Windows XP SP3.
