It may be a sad fact that CDP will lose that they breached the contract by removing DRM without NB permission.
If that's the case NB will see the end of me buying any games published by NB. also it's morally unethical to witheld payment to CDP which is rightly theirs. I believe CDP should sue NB for this instead

They fought for weeks over the DRM leading up to the release, so I find it hard to believe that they wouldn't include some kind of provision that allows them to remove the DRM at their discretion once it's rendered irrelevant by piracy. It's pretty obvious that they always planned on taking it out, after all. Suppose it all comes down to the phrasing in the contract.

Regardless of how the court ruling turns out, it won't look good for Namco-Bandai.

I'm referring to the fact that NB is suing CPD for removing DRM without the former's expressed "permission". I don't think PC users react well to that.

Is Atari involved in this at all? They don't seem to care about the DRM being removed.

vAddicatedGamer: I think Atari was bought over by NB, and NB is the one who is concerned about DRM removal.
Atari Europe was taken over by Namco Bandai. Here's a link to a few very interesting articles on Namco Bandai and it's planned futures.

Yeah it's strange that NB would make a ruckus about the DRM but not Atari (US).

Not really as it doesn't directly concern them (Atari US) and legally they probably can't officially comment.
Maybe NB is still making payments? =P
In so far as being a subsidiary of NB, yeah. =)

Wiki only says "In May 2009 Infogrames Entertainment, SA, the parent company of Atari Inc. and Atari Interactive Inc., announced it would be changing Infogrames' name to Atari, SA."
The one mention of NB is "Namco Bandai has purchased a 34% stake in Atari Europe on May 14, 2009, paving the way for its acquisition from Infogrames."
