I tried the EE preloader again but it did not want to download anything else (was it meant to?) anyway here is what I did

headed over to http://en.thewitcher.com/ee_manual/

download the 3 files part 0 and part 1 right from the top and then part 1 from your desired installation language in my case it was TW2EE_Patch.exe, TW2EE_Patch-1.bin and TW2EE_EN_Voiceover.exe

saved them to the same directory as the preloaded and run TW2EE_Patch.exe to install

hope that is useful to some (probably not)

That worked.
Plus, I DL'ed all the Part 0 files for the Language Packs, as well.
