Biggest polish gaming site yes its credible yes but when it comes to games not law suits , redactor that wrote arcicle was way to much panicking and trying to make it sensational :)

No more Namco Bandai games for me, contract or not I honestly don't care.

I won't be buying in any Namco-Bandai products across any platform; PC, PS3, Xbox, PSP or iTunes store..gonna persuade my friends to stop doing it too.. (those who brought played and liked Witcher 2, and they aren't gonna be pleased ONE bit..)

I didn't even know Namco-Bandai were still around, since the 90s, until this came up...

So Namco-Bandai is suing CDPR, because they stripped DRM out of the PC release and agreed to let THQ publish the XBox 360 version, because Namco-Bandai didn't/wouldn't agree to publish on XBox. Now that TW2 is a bigger hit than NB thought it would be, Namco-Bandai is pissed off that they blew off CDPR's offer of first refusal and is holding back a million dollars, or so, in payments owed.

Sounds about the same as someone else posted a few weeks ago. Hopefully it will get resolved quickly (less than one year) and in favor of CDPR.
I'd hate to see Namco interfere with CDPR's plans, but I admit I cheered when I first saw the thread title...
someone get us some email addresses for Namco Bundão (asshole in my language) and the Lyon court and let's have them knowing what we think about the subject!
You know… I read this article in Polish (my first language)… and I think that BN is acting unethically and is trying to force CDPR into doing something they say they made it clear they did not want to and never signed on to do. Furthermore it clearly states that it was BN that wanted DRM in the product and is not getting upset with CDPR when they decided to patch removed it.
So for once can we quit whining on GOG.com about some DRM and how it’s GOGs and CDPR fault… learn to read and know your facts.

As for the future of Witcher 2 on consoles. The CDPR owners stated that they are comfortable they will win this, it’s going to EU court in September and for now the only slowdown is that THQ (who signed on as a 360 distributor) cannot do any distributor duties or preparations.
Isn't withholding owed funds from another company for such a contrived reason technically illegal?

I mean, it's not like I could start up a company and refuse to pay people who do things I don't like. Not that I know much about the law, but it seems like grounds for a huge, Namco-Bandai-destroying counter-lawsuit.

No, withholding payment in a contract dispute is a standard tactic. It has to be a good faith dispute, and if it's a dispute over part of the payment due, you can only withhold that much. French law isn't the same as US law, but France (as do most civil law countries) takes "good faith" in contracts seriously.

Whether the reason is a contrived one is for the court to decide. It is worrisome in that regard that this matter is being litigated in Atari Europe's "home court" (Lyon, France).

Ah, thanks for clearing that up for me.

Seems pretty unfair, but I don't really have the necessary grasp on the law to completely understand the situation. Regardless, litigious whining because someone else is going to make money off of something that you passed on is just classless. I just hope that the contract between them is as airtight as a CDPR spokesperson made it sound when this issue first arose.
