Anybody else getting some pretty bad screen tearing while running the game under d3d9 mode? The tearing goes away running in Direct Draw 5, but the game becomes a little sluggish. Tried forcing vsync though the nvidia control panel but didn't work.

I'd say you should contact the publisher at support[at]screen7.co.uk. That's probably some engine-related issue.
Force vsync through your graphics card options, if that doesnt work download rivatuner and launch d3doverrider which is bundled with it and mae sure vsync and tipple buffering are checked, that never fails for me
jamiehavok is right that it's likely a Vsync issue and if you're able to get it running by one of the suggested methods you may have some luck. I've explained a little further about what we now know and what we're doing to fix it here: http://www.gog.com/forum/the_cat_lady/lag_issues/post8
