My rule is that the attacker should always flee. But it's not always followed. And 20 minutes of laser fire deciding nothing, sometimes I've had to flee my planet just to keep the game moving.

Eventually, someone will get the upper hand. It just might take a while. Go get a cup of coffee or something.
I tend to flee as attacker unless there is some special target (i.e, ship) I want to distroy first
Always depends on the ships used in combat. Every space battle is winnable to some degree, unless someone brings an interdictor to the party. What sort of match ups do you usually encounter or even consider unwinnable? I may have a few tips to help you overcome a few obstacles.
