Yes! I am curious. I'd like to find a way around the limitations as well...
Someone needs to figure this out. I tried editing the resolution lines in the config files, and then tried deleting the config files altogether, but it seems the game engine automatically creates new ones when you start the game if those files are missing or have been edited. Google searching hasn't brought up any solutions either. I feel like there must be a simple solution we are overlooking, but I'm at a loss, currently.

I got it by adjusting the resolution using the in game settings. I think the max res was 1600x1200
In my (admittedly limited) digging, it appears the resolution options are hardcoded into the EXE or one of the other game files. I cannot find an editable file or registry string that will allow true widescreen resolutions... yet.

1600x1200 is not widescreen, that's true 4:3 resolution, not 16:10 or 16:9. Some monitors will stretch the horizontal or crop the vertical on 1600x1200 to widescreen because the vertical res is beyond the monitor's physical limits (if your monitor maxes out at 1080, it can't actually do 1200). Either way you are not getting an actual widescreen res, you are either getting stretched/squished visuals or losing the top and/or bottom of the entire image.

Yeah, I believe the in-game settings allow you to max out the resolution to match whatever your screen's native vertical resolution is, but it'll always be in 4:3 aspect ratio, so you'll have those unsightly black bars on either side. This may simply be something that someone will have to make a patch to get working, which seems unlikely at this point. In my Googling, I did come across someone who had posted super high resolution screenshots from the game on some graphics showcase forum, but I think they may have been running the PS2 or Xbox version through some kind of emulator. In any case, they didn't say anything about how they achieved those visuals.
Another game with resolution hardcoded into the exe? Sigh. Looks like a no buy, was already hit twice with Robin Hood and Nox.
This isn't going to be very helpful because I can't remember how I managed to do it, but through some hex editing and cfg altering and some dx8 to dx9 converting, I somehow managed to get the game to play in 3840 x 2160 with correct aspect ratio. But this was like two years ago and I didn't backup whatever it is I did. It had some glitches like this (text wasn't centered), but it played fine. I'm going to try to tinker around with it and see what I can find. I may have even used some files from The Collective's other game, Marc Eckō's Getting Up: Contents Under Pressure from Steam which uses the same engine and has been updated to allow HD resolutions.
It would be amazing if you can recall how you edited the resolution, closer1000! Hopefully with no stretching or black bars.

I'm waiting a little on buying till I see how this version is. I would really love to play it in 1080p. I used to have a lot of fun with the game on xbox, but never completed it. :)

My apologies. It was late when i got home from work and had it installed etc. I did not realize at the time it was just stretching the image.
closer1000 it would be fantastic if you could get an eye on the exe. Maybe you will recall the hack that you have done to abilitate the widescreen resolutions.
Since there isn't a working widescreen solution at the moment the best way I've found to play this game on a 1080p monitor is to set the resolution to 1440x1080 and just play it in 4:3.
Since 1440x1080 isn't a standard resolution you have to use your video card driver control panel to create a custom resolution.
Once that's done modify the vars.cfg file and set the following values:
res_height=1080
res_width=1440
As some will have found out if a non 4:3 resolution is set, it defaults back to 640x480. Since 1440x1080 is a 4:3 resolution, the game runs it without issues. The picture looks much sharper as it allows the monitor to display a native pixel perfect 1080p rather than having to upscale 1280x960.
Also use your video card driver control panel to force anisotropic 16x and anti aliasing for this game. Set the frame rate cap to 60 in vars.cfg. With that setup the game runs smoothly and looks nice albeit in 4:3
Has anyone gotten maximum 4:3 resolution on a 1440 display, 1920*1440, to work?
I've never used a Hex Editor until today. I only managed to find this in the main executable, I didn't manage to find anything else.

PS: I'm not sure why you'd set the cap to 60, when you can just disable it completely and never worry about it anymore.

Bought the game and craving to play. Can't stand the 4:3 aspect ratio. Need widescreen desperately. Anyone figured how to change the resolution yet? :(
