Jazz Jackrabit was a joint venture between Epic and a company that's now part of Sony. So it's not even abandonware as the copyright holders still exist.
Having said that, even if it was abandonware, that just means that the copyright holder is no longer active, not that it isn't copyrighted anymore. Copyright law is a complex thing, but essentially something that was copyrighted remains so until the copyright expires. The copyright may fall back to the initial creator or his heirs, who might not even be aware that the copyright is theirs, but it still exists. So please, remove the link.

I'm sorry too. Didn't mean to blow my top there. It's just been happening a lot here, and I'm getting tired of it. Of course, it's not the same people doing it again and again.
Anyway, the term "abandonware", when used about games, usually means "a game that is not sold anywhere any more". That does not mean that the game is free all of a sudden. For a more in-depth explanation, see the Wikipedia entry for Abandonware.
Considering that copyrights last for almost 100 years now (usually the life of the original author/copyright holder, plus 50 - 70 years), almost nothing from the "video game age" will become part of the public domain (i.e. true "abandonware") within our lifetimes.

Except if it is made so by the copyright holders, which does happen from time to time. Beneath A Steel Sky is a case in point.

Hence why I said "almost nothing". There will always be exceptions like BASS, but we will never live to see anything from this age enter the public domain "naturally".

Sadly, no. And in 80 years time, I doubt anyone is going to care about Dungeon Keeper :-(
I find that a shame really, many companies could release their oldest games as freeware, especially if they are not looking for extra sales revenue, but sitting on them. (I'm looking at you, Lucasarts and EA!)
I think its sad that companies like EA sit on this catalog of old games that they could actually still be selling for pure profit, and instead turn around and lay off 10% of their workforce to save money.
