Good question and I'm 100% sure that it's not illegal. You have to pay for the RPG Maker programs and they encourage you to sell and make games of your own.
Seeing as RPGFAN.com reviews them says enough for me :-)
Besides that, some of those games ( LIke Aveyond. ) are being sold ( Albeit easier versions for the mainstream. ) on sites like bigfish.com
If you google a bit you'll see the games I'm talking about a lot on different sites.
The reason why not a lot of games are being sold this way is that well, you can create your own so not a lot of people are willing to pay for something you can create yourself.
Mind you, I can tell from first hand experience that it's so d*mn difficult to make a good and working RPG game let alone one that last for hours and hours.
By the way, they say that Laxius Force 2 takes more then 80 hours to complete!

These are RPG games created with RPG Maker programs. ( Mostly with VX and XP ) With these programs you ( People like you and I. ) can create your own RPG games. The games I'm talking about are created by skilled people and are so big and professional that they're sold online. ( Eternal Eden takes about 20+ hours to complete. )
Most of these games are reviewed on RPGFAN.com ( Any RPG games should know that site in my opinion :-) )

@ Lou: Indeed, they are SNES like RPG's. I would really and I mean really tell you all here on GOG.com to try Eternal Eden! ( And no, I'm in no way connected to that game, I just love it that much! ) I've played A LOT of rpg's and that one is so extreemly fun to play!
