Sharing a game with others that is discontinued from the publisher would be a candidate for the 'ok' clause. That's why sites like Abandondonia exist, to preserve what is no longer available at retail. Like Wing Commander 'Prophecy'.

Otherwise it would be illigal to give away Star Wars action figures years after you bought them because Star Wars is a trademark of Lucasfilm LTD.

Speaking of that...anyone read the fine print at the bottom of the Droid advertisements?

Im totally fine with that too. The problem is that there seems to be a greay line in abandonware. I mean, some games like System Shock 2 are in practice abandonware, but technically they arent. EA, which currently holds the right to it, already said System Shock 2 isnt abandonware. That creates a big problem. They dont produce the game anymore, and the only way you can find it is through extremely overpriced rare units on ebay. The cheapest copy of System Shock 2 ive ever found was 50 dollars there. Thats for an used copy which doesnt even come with the original box. Im morally ok with downloading games like these, since its almost impossible to obtain a legit copy, even though technically its still piracy. I dont do it myself because im a collector.

Since abandonware isn't an official term, companies can't use it to state whether their product is or isn't it......i.e. it is abandonware if it meets the criteria. Also EA is dicks.

Yeah i know, but those who hold the rights decide what to do with it. I dont remember who holds the rights to the first System Shock, but they just decided its ok to download it for free since they cant sell it anymore. Even Bethesda did it with the 2 first TES. System Shock 2? "No, you cant have it, and we dont sell it anymore, so screw you, hahahahahahaha" EA said.

I know they decide what to do with it legally, but the term was made up by software pirates and similar people, and as such it can't be applied normally by rights holders but rather by those who infringe upon said rights holder's property for various reasons.

And yeah screw EA.
