StingingVelvet: The main thing on my mind when writing that was how certain words and images are illegal in Germany.
We have illegal signs, but not words. This oes more in the vein of "state protection" than minority protection. If you show the swatzika flag you are denouncing the german state (among other things). I think "flag burning" would be the equvialent in the US (Is that actually illegal?).
The denial of the holocaust (or rather all of the crimes done during that time) is illegal and that is highly, highly,
highly controversial within the legal community. In a nutshell, we have a conflict between the freedom of speech and the dignity of the victims of that crime. And in the german constituion,
human dignity reigns above all. Literally and legally. This is why the impairment of the freedom of speech is allowed by the constitution.
