The Ip isn't the problem. That gameing concept can stand on it's own. Just look at Startopia. Heck, being free of an IP might even make it better.
Well it looks like the indie genre better look out, they're about to be rebranded.

wodmarach: MS has changed in the last few years increased talks with OSS devs opening of API's etc etc Apple is rapidly becoming the more hated company for it's actions. MS will cross patent Apple demands your patents but won't patent exchange (hence the law suits against them and by them where most phone companies agree to cross lisence as part of RAND Apple is refusing and calling it non-RAND)
No, they really haven't. They only recently got off DOJ supervision, I wouldn't expect them to be back to their old stuff for another couple years.

That being said, it's harder for them to embrace, extend and extinguish than it used to be. Talking with OSS devs could very easily be the first step in the sequence.

And don't forget about the great difficulty in buying computers where MS doesn't get a licensing fee.

No they really have. The current heads of many of their departments are OSS supporters and their influence is being felt Stack code and touch code by MS has been passed onto OSS groups research projects are now shown not kept hidden and patented. Hell they even have an OSS license.
Compare to Apple where Research projects are kept secret and people rely on patents, contact with OSS is dropping and they have stopped using their OSS compatible license, Darwin which WAS open is now closed and they only release the part they are forced to by the BSD and GPL.

I'll believe it when I see it. MS is every bit as evil as they used to be. It's not even particularly well hidden that they extort royalties for questionable patents and require companies to sign NDAs if they want to see what they're alleged to have infringed upon.

Thankfully B&N has had the stones to tell them to feck off, but if you think they've changed, you haven't been paying any attention to their behavior of late.
populous, theme park, dungeon keeper, black and white, the movies.. those are all wonderfull games and so unquie. Sure they all have their flaws, but what game doesn't? I would like to say i'm shocked at the negitivity, but sadly these days there is nothing but negitivity about anything.

People that are saying he has done nothing for the gaming universe really need to have their head examined. Or perhaps you can do it better...
