Yes. Free as in speech, not as in beer. Releasing the game data would essentially be releasing the game for free.
On a side note, the HIGB site was updated after I posted it: Aquaria, Gish, and Penumbra Overture will also be going open source.

Just downloaded it and compared it with the retail copy, and so far the complete gamedata seems to be there. Will try to compile it later on ;)

Still, it's a very good sign for the future of Lugaru.
