kodeen: They will if they want to be in an HIB, they are immensely popular and developers want to be in them. HIB still has the right to demand DRM-free and cross platform.
Sure they have the legal right to do that, but they have lost the negotiation leverage to pull in off in practice by doing this bundle. When I first heard of this Bundle before they officially launched and announced that it was Windows only and DRM free only my immediate thought was :"Wow Humble Bundle just used their leverage to get a AAA publisher to release a bunch of their games as cross-platorform and DRM free" boy was I disssappointed! Sure they may get some devs that actually have DRM free and cross-platform as ideals to sign up for future bundles but 95%+ of those devs have already ported their games, and already provide them DRM free. So the Humble Bundle guys won't be able to entice more skeptical developers to do that.
