Unrated movie/game/etc. are equivalent to being on the index. That's really annoying when ordering things on amazon, like the complete 'Allo 'Allo box, which would probably have an age restriction of six in Germany.

In 80% of those cases it's either publisher or the law screwing with you. Blaming Steam all the time is mostly "shooting the messenger".

Valve wants you to buy games, and they will take that as far as they can without burning themselves. Ignoring the toothless JuSchG? Sure. Committing a crime? Not so much.

You mean like Recettear or Shadowrun Returns, which as far as the law is concerned, as treated in the same way as Dead Island: Riptide? Technically speaking, no, it is not a 'free for all'. Steam should theoretically be performing conclusive age checks, but as you've stated, they don't bother with such formalities.

The only thing that German law has an influence on at present is the distribution of the physically packaged version of Dead Island: Riptide, as unrated games are treated as per USK 18-rated games.

But you already know this.

SimonG: Steam actually does make a criminal offence by doing this, as they do not have a reliable age verification. They don't really care about hose "youth protection laws", but they sure as hell won't act against the criminal code.
Thank you for the clarification. I guess I was thinking that the age check was made during purchase, not during redemption, but seems like it has to be done during both steps.

No. See my comment above. Unrated is equivalent to a USK/FSK 18 rating, not being on the index.

It's like the way a lot of people assume that "SPIO/JK geprüft" means that the film or game is on the index. It doesn't. The logo only means that they have been reliably informed by an approved body - the "Juristenkommission" - that the game or film does not break the law (although I've never seen this logo on a game).

It's purely circumstantial that a game is refused classification and then indexed. One does not necessarily follow the other.

I aknowledge you are firm supporter of Steam, I grant you that. I don't where you got that 80% numbers, but anyway.

Considering that this "messenger" has more than 5 Million users online each day at the same time, that's no longer a mere "messenger" that freaking United Parcel Service Global thing. I believe they have more weight than they actually admit considering the "decisions that only publishers fell"

Now, the above mentioned is all an asumption though.

The problem is that Steam has a monopoly on some games, and when those games happen to be censored or on Index List A things are starting to bother me, because I have no legal of way playing this game in Germany.

Explain to me, why I can't buy a European copy of Titan Quest and play it in Germany?
Why is the German Fallout NV only available as a low violence version?
Why can't I buy Shogun Total War Blood DLC?

Because Steam doesn't care if you are above 18 and doesn't include an optional maturity check.
Is this Steam's fault? Well, I honestly think so.

In other words, if the messengers fails to include a maturity check and refuses to look at my ID
