My respect for Bethesda has plummeted.
Tony Montana: You know what capitalism is? Getting fucked!

You guys remember Bethesda going after Notch? They are worse than EA.

This thread is about capitalism, not communism.

No I was just making a Tony Montana reference.

Notch tried to trademark the word "scrolls". That makes him just as bad as Bethesda and EA.

Crosmando: So in my internet travels I just came over this, regarding how Bethesda (and it's parent Zenimax) deal with third-party developers. A user seems to pretty much say how Bethesda managed to buy-out Arkane Studio during it's development of Dishonored:

Check out this gem:

Does everybody in this thread realize that what is quoted in the first post is just a post by some guy on a forum, commenting on a news story about Prey 2?

The OP presented this quote as if it were a news article or some other trustworthy source. It's some internet forum poster asserting things with zero attribution.

I'm not ready to get outraged by this.
Dishonored turned out to be what it is despite Bethesda not because of it.

AFAIK, he didn't actually tried to trademark anything, he just wanted to name his game Scrolls, which caused Bethesda, who owns the "Elder Scrolls" trademark to threaten him with legal action.

In their defense, according to IP law they pretty much had to do that, since from what I understand, if a lawyer can prove you didn't defend your trademark, you lose it.

I didn't present anything as news, it's an unconfirmed statement/opinion, but then again something of this nature will likely NEVER be officially confirmed (companies of this size never comment on things like this) unless Arkane decided to sue Bethesda for breach of contract, but LOL that's never going to happen because Bethesda magically managed to buy-out Arkane during Dishonoured's development.

According to Wikipedia and Gamasutra part of their settlement was that Notch/Majong would not trademark "Scrolls". So I got the impression that they planned to do it.

What I'm saying is we have no reason to suspect anything happened at all, do we? Did I miss something? Why did the forum-goer you quoted spin that story? Why do we suspect anything at all?

All I know is that Zenimax acquired Arkane. Why should I think it is surprising or suspicious that a large rich company buys a smaller company that is doing well? Doesn't that happen all the time? And doesn't it often happen in part because the people who have a stake in the smaller company would like to get paid after their years of hard work developing a good company?

You may hate the system. I may hate the system. We both may agree that it is bad for creativity. But, why am I supposed to suspect that something nefarious happened here?

Well, I don't know. I didn't like Minecraft so I pay little attention to what Notch does. But I've never seen any mention of him wanting to trademark "Scrolls". Legally, you can't trademark common English words, anyway.
I wish developers has some more pride and were not so desperate to be in the video game business, and open themselves up to be abused by the big predators. They's probably get better paid writing business software from 9 to 5 anyway.

Crosmando: If Arkane doesn't do either, then Zenimax will take them court for breach of contract since they're now so far behind in the project.
Remember, it's because Zenimax's company Bethesda has been rejecting milestones that put Arkane behind in the first place.
Singing a contract with a catch 22 and no outside independent quality inspector is... well, it's not really ideal, is it? No wonder anyone can take advantage of such concepts as "quality". As far as I know, Bethesda might have actually perceived the quality of the developing game to be inferior to what was contractually agreed upon.
