So not long ago I put up a thread about the fact I spent a heap of money on a motherboard that turned out to be faulty...

So after I spent a tenner returning it by tracked postage I get an email this morning from the seller claiming that I have broken the CPU slot. I have bent pins and put cooling paste in there for good measure. Something, only a complete prat could do...

I know for a fact it was not in that condition when it left my house but of course it goes against the warranty.

I could use a little advice here.
File in a formal complaint, send another to the applicable government body, aaaaaand.... that's it.

They either deliberately or mistakenly swapped the motherboards, or just simply damaged it themselves. The more official complaints they rack up, the better the chances an inspector will get wise of the situation.

The part that makes me hesitant is the simple fact how can I prove I didn't break it? Wouldn't they automatically side with the seller?!
If you paid by credit you can talk to your credit card company regarding a purchase that was incomplete or fraudulent, and they will either send statements to this guy or retract the charges. Other than that all I can advise is sending a consumer report as stated above.
And that's why I don't like using ebay. I can trust newegg and amazon not to do that shit, but some random bastard on ebay... I hope you get your replacement or refund from ebay. You could also dispute the charge with your credit card company (if you used one).
I am ready to pull my hair out already. The seller has not replied to my current/last email. I need to see what they're going to say before I log a complaint.

So has anyone put a complaint in like this before? I am not too great with this stuff.

Have you tried contacting ebay about it yet? I know they offer buyer protection on certain items.
Oh well, I guess there's no point sugar coating it. Unless they somehow reverse their decision, lodging a complaint has zero to minimal chances of succeeding. Having a known reliable supplier is a better idea and generally worth it's price.

Did you take any photographs before sending it back? Like someone else said earlier, file a claim with E-bay. Hopefully you will get this matter fully resolved. Good luck.

No, it came out the box, into my machine, out my machine and back into the box. I didn't have it sitting out long enough to even consider it. My own mistake that is for sure.

Unfortunately, all a photograph would prove is that it was in okay condition at some point while it was in his custody. It doesn't prove that he shipped it back in that condition.
Is this seller from UK?

Don't hesitate too long. Buyer protection only lasts a certain number of days from the transaction. Most villainous ebayers will delay communcation with you, only occasionally progressing the dispute, until buyer protection runs out. And then you're screwed.

If they're saying you broke the board and you didn't, immediately file the complaint. Waste no time on them. File the complaint with ebay right after you read this message. And then send in a consumer complaint through whatever channels you have available.
Ive had a similar issue.

I spoke with the seller at length with him repeatedly accusing me of damaging an item that I hadnt even broken the seal on.

In the end i gave the seller an ultimatum, replace the part for a non faulty one or I report the issue to ebay and have the funds reversed through paypal, I gave him 2 days to reply, which he didnt. I filed the complaint with ebay and contacted paypal. I got my money back and a generic apology from ebay.

there is more to that story but its boring and unimportant.
File a grievance, they always, ALWAYS, side with the buyer.

I stopped using ebay three years ago when a guy bought a defective item identical to my item, then filed a grievance and said mine was defective. It was a super obvious scam to get my working item for the defective item price. I showed the evidence to ebay and they still sided with him. They didn't even make him return anything.

Scaaaaaaam site. Stop using it.
